Plonsky understands that in today’s present climate many individuals choose to protect their individual assets during their marriage and desire to have a Prenuptial or Postnuptial Agreement. Without this agreement any assets acquired during the marriage will be distributed equitably between the husband and the wife during a divorce. A Prenuptial or Postnuptial Agreement is basically a contract between the husband and wife deciding what will happen to your assets in case of a divorce (even if it doesn’t comply with the divorce statute for the distribution of assets). This Agreement can also be a very effective Estate Planning tool for second marriages who wish to leave their estate to their biological children in lieu of their new spouse. (Note: Under Florida Law, you are required to leave your spouse 30% of your estate in your Will or Trust unless a Prenuptial or Postnuptial Agreement is made).
